What is a Party Wall Award?
The process and requirements of a Party Wall Award are as set out in the Party Wall etc. Act 1996. A Party Wall Award is an agreement made between at least two neighbouring occupiers prior to the commencement of construction/building work which is to be undertaken to a party boundary or structure, or where works are being undertaken in close proximity to a party boundary or structure. There are three main types of work which require a Party Wall Surveyor to conduct a Party Wall Award and these are:

  • Line of junction (building a new wall on or alongside a boundary)
  • Party Structure Works (works to an existing party wall such as cutting into, rebuilding, thickening etc.)
  • Adjacent Excavation (excavations to a lower level within either 3m or 6m of an existing building)

Why is a Party Wall Award required?

The Party Wall Award will define the scope of works which are to be undertaken and the associated arrangements including working hours, noise levels, timescales, who is responsible for the associated costs etc. The Party Wall Award provides protection to both Parties to ensure that the works are undertaken to a suitable standard and that should any issues arise there is an appropriate agreement to resolve these. 

Should a Party Wall Award not be agreed prior to commencement of notifiable works then the other Party(s) could impose an injunction, which will halt the works whilst an Award is agreed. In other circumstances a neighbour could make claims of damage or disrepair. This can be difficult to disprove and  Court’s generally side with the neighbour who is not undertaking the works, leading to increased risk to those undertaking the works if they do not agree an Award. 

A separate agreement is sometimes made when a Party agrees to site scaffold on another Party’s land, and this is called a Scaffold Licence. The process is similar to a Party Wall Award.
